Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Rify mobile application ("App"), operated by RIFY PTY LTD ("Rify", "we", "us", or "our").

By accessing or using the App, you confirm that you meet the minimum age requirement applicable to your jurisdiction (see Section 1), that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, you must not use the App.

1. Eligibility and Minimum Age

1.1 Australia

In accordance with the Online Safety Amendment (Social Media Minimum Age) Act 2024 (Cth), which came into force on 10 December 2025, you must be 16 years of age or older to use Rify if you are located in Australia.

By creating an account, you represent and warrant that you are aged 16 or over. We take reasonable steps to prevent users under 16 from creating or maintaining accounts, including collecting and verifying date of birth at sign-up, server-side age validation, and deactivating accounts found to belong to users under 16.

If you are a parent or guardian and believe a person under 16 has created an account, please contact us at support@rify.com.au so we can investigate and take appropriate action.

1.2 Minimum Age by Jurisdiction

For users outside Australia, the following minimum ages apply. Where a jurisdiction imposes an age higher than 13, that higher age applies. Where no specific law exists, a default minimum age of 13 applies, consistent with international baseline standards.

Where a jurisdiction permits a lower minimum age subject to verified parental consent, Rify does not currently offer a parental consent mechanism and therefore applies the higher threshold. This table will be updated as laws change or as Rify launches in new markets.

1.3 Misrepresentation of Age

If you provide a false date of birth to circumvent the minimum age requirement, you are in breach of these Terms. Rify reserves the right to immediately deactivate any account found to belong to a user who does not meet the applicable minimum age, without notice and without liability.

1.4 Legal Capacity

In addition to the age requirements above, you must have the legal capacity to enter into a binding agreement under the laws of your jurisdiction. If you are entering into these Terms on behalf of a minor with appropriate parental or guardian consent (where applicable), the consenting adult accepts full responsibility for compliance with these Terms.

2. About Rify

Rify is a location-based platform that allows users to request, share, and access real-time, community-generated information about nearby places.

Content shared on Rify may include camera-captured photos, short text-based public service announcements ("PSAs"), and location-related metadata. All content is user-generated and provided for informational purposes only.

3. Informational Use Only

Rify does not guarantee the accuracy, completeness, timeliness, or reliability of any information shared through the App. Information may be time-sensitive and may become outdated quickly.

You acknowledge that you must not rely on content in the App for safety-critical, legal, medical, financial, or other professional decisions.

Rify does not provide emergency services, safety alerts, or hazard notifications. You use the App and act on its content entirely at your own risk and discretion.

4. User Accounts

Certain features of the App require the creation of a user account. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You may request deletion of your account using the in-app data deletion request feature or by contacting support. Account deletion may result in the removal of associated content, subject to legal, safety, or operational requirements.

You agree to notify Rify immediately of any unauthorised use of your account or any other breach of security.

5. User Content

You retain ownership of the content you submit to Rify. By submitting content, you grant Rify a non-exclusive, worldwide, royalty-free, sublicensable, and transferable licence to host, store, display, reproduce, distribute, and use your content for the purpose of operating, improving, moderating, and promoting the App.

This licence continues while your content remains on the App or is otherwise retained for legal, safety, moderation, or operational purposes, including after account deletion where applicable.

6. Camera, Location & Permissions

The App requires access to certain device permissions, including precise location and camera access. Photo uploads are limited to camera-captured images only.

If you deny required permissions, certain features of the App may not function correctly.

Rify may use third-party services, including analytics and advertising providers, to support App functionality. Any advertisements displayed will be handled in accordance with our Privacy Policy.

7. Acceptable Use

You agree not to upload, post, or share content that is illegal, fraudulent, misleading, harmful, abusive, harassing, threatening, sexually explicit, discriminatory, unsafe, or otherwise objectionable.

You also agree not to:

• Attempt to circumvent age verification or minimum age requirements by any means, including providing a false date of birth or using another person's account
• Create or maintain an account on behalf of a person who does not meet the applicable minimum age
• Use the App in any way that violates applicable local, national, or international law or regulation
• Attempt to gain unauthorised access to the App, its systems, or the accounts of other users

8. Content Moderation

Rify reserves the right, at its sole discretion, to remove, restrict, or disable access to content or accounts that violate these Terms or applicable law, without prior notice.

While Rify may moderate content, we do not guarantee the review, removal, or response time for any reported content.

9. Account Suspension & Termination

Rify may suspend or terminate accounts, restrict access, or remove content if these Terms are breached or if usage poses legal, operational, or safety risks. This includes, without limitation, accounts found to belong to users who do not meet the applicable minimum age requirement.

10. Availability

We do not guarantee uninterrupted or error-free access to the App and may modify, suspend, or discontinue features or functionality at any time, without notice.

11. Limitation of Liability

To the maximum extent permitted by law, Rify and its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.

12. Indemnification

You agree to indemnify, defend, and hold harmless Rify, its officers, directors, employees, and agents from any claims, losses, or liabilities arising from your use of the App, your content, your breach of these Terms, or any misrepresentation of your age or eligibility to use the App.

13. Changes to These Terms

Rify may update these Terms from time to time. Material changes will be communicated within the App. Continued use of the App after updates constitutes acceptance of the revised Terms.

14. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Australia. You agree to submit to the exclusive jurisdiction of the courts of Australia, to the extent permitted by applicable local law in your jurisdiction.
